Universal Background Checks: An Essential Step towards Gun Control
In the wake of numerous mass shootings that have rocked America in recent years, there has been a growing call for stricter gun control laws. One popular proposal is universal background checks, which would require all gun buyers to undergo a background check, regardless of where they purchase the firearm. This measure has received widespread support from lawmakers and the public alike.
But what exactly are universal background checks? How do they work? And why are they so important?
Currently, federal law requires licensed firearms dealers to conduct background checks on prospective purchasers before selling them a firearm. However, this requirement does not apply to private sales, such as those between individuals at gun shows or over the internet.
Universal background checks seek to close this loophole by requiring all gun buyers – whether purchasing from a licensed dealer or an individual – to undergo a thorough criminal and mental health history check before obtaining a firearm.
The benefits of implementing universal background checks are numerous. First and foremost, they can help keep guns out of the hands of dangerous criminals and individuals with severe mental illness who may pose a threat to themselves or others.
Studies have shown that states with universal background check laws experience fewer deaths due to firearms than states without these laws. For example, after Colorado implemented its own legislation in 2013 requiring background checks for all gun sales and transfers (including private transactions), there was an immediate reduction in homicides committed with firearms by 34 percent.
Moreover, universal background checks could help prevent suicides by limiting access to guns during moments of crisis. Research indicates that suicide attempts using firearms are often fatal – approximately 85 percent result in death – while only 2 percent of suicide attempts involving other methods end up being fatal.
Another benefit is that these measures enjoy broad support among Americans across political parties: According to polls conducted by Pew Research Center and Quinnipiac University Polling Institute respectively; around nine out of ten Democrats (93%) and independent voters (89%) support universal background checks, while even six out of ten Republicans (60%) favor this proposal.
Despite these benefits, there are some who argue that universal background checks are unnecessary or would infringe upon the Second Amendment right to bear arms. However, these arguments do not hold up under scrutiny.
Firstly, it is important to note that universal background checks would not prevent law-abiding citizens from owning guns. Rather, they would simply ensure that only those who meet certain safety criteria have access to firearms – just like requiring a driver’s license ensures only qualified individuals can drive cars.
Secondly, the Supreme Court has upheld that reasonable gun regulations are consistent with the Second Amendment right to bear arms. In District of Columbia v. Heller in 2008, the court stated that “the right secured by the Second Amendment is not unlimited” and “is not a right to keep and carry any weapon whatsoever in any manner whatsoever and for whatever purpose.”
Thirdly, opposition often comes from various interest groups funded by firearms manufacturers and their supporters who seek to maintain lax gun laws as well as stoke fears that stricter legislation will lead to an erosion of all gun ownership rights – which does nothing but muddy our understanding on this issue.
